Comply with all applicable laws and regulations while using our Services. You agree not to misuse our Services or use them in any way that could harm Freeroam.AI, its users, or third parties. 3. User Accounts To access certain features of our Services, you may be required to create a user account. You are responsible for maintaining the confidentiality of your account information and password. You agree to notify Freeroam.AI immediately of any unauthorized use of your account or any other breach of security. Freeroam.AI will not be liable for any loss or damage arising from your failure to safeguard your account information.
4. Subscription Plans and Payments Freeroam.AI offers both free and paid subscription plans for access to various features of our Services. If you choose to upgrade to a paid plan, you agree to provide accurate payment information and authorize us to charge the applicable fees. Fees may vary depending on the services selected and are subject to change with notice. Billing and Payment: All fees are billed in advance and are non-refundable unless otherwise stated in a specific service agreement. You are responsible for keeping your payment information up to date. If payment is declined or overdue, Freeroam.AI may suspend or terminate your access to the Services until payment is resolved.
5. Intellectual Property Freeroam.AI owns and retains all intellectual property rights in the website, services, and all related content, including but not limited to software, logos, designs, and trademarks. You are granted a limited, non-exclusive, non-transferable license to use the Services for personal or business purposes in accordance with these Terms. You agree not to: Reproduce, distribute, modify, or create derivative works of any part of our Services without our express written permission. Reverse engineer, decompile, or disassemble any part of the Services.
6. User Content By using our Services, you may upload or input content, such as business information or communication data (“User Content”). You retain all rights to your User Content. However, by submitting User Content, you grant Freeroam.AI a worldwide, non-exclusive, royalty-free license to use, copy, store, and process your User Content to provide and improve the Services. You agree that: Your User Content will not violate any third-party rights, including intellectual property rights or privacy rights. You are solely responsible for the legality, reliability, and appropriateness of any User Content you submit. Freeroam.AI reserves the right to remove any User Content that violates these Terms.
7. Confidentiality and Data Security Freeroam.AI takes reasonable measures to protect your data and ensure confidentiality. However, we cannot guarantee the absolute security of your data and encourage you to take appropriate measures to protect your information. You agree that Freeroam.AI is not liable for unauthorized access to your account or data, except in cases of gross negligence or willful misconduct.
8. Third-Party Services Freeroam.AI may integrate with or provide links to third-party services. These services are governed by their respective terms of service and privacy policies. We do not control and are not responsible for the content or practices of third-party services. Your use of third-party services is at your own risk, and you should review their terms before engaging with them.
9. Termination Freeroam.AI reserves the right to terminate or suspend your access to the Services at any time, with or without notice, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Services will immediately cease. Any outstanding fees will remain payable, and all licenses granted to you under these Terms will be revoked.
10. Disclaimer of Warranties Freeroam.AI provides the Services on an “as is” and “as available” basis, without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Services will be uninterrupted, error-free, or free of harmful components. You use the Services at your own risk.
11. Limitation of Liability To the fullest extent permitted by law, Freeroam.AI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising out of or related to your use of the Services, even if we have been advised of the possibility of such damages. Our total liability to you for any claims related to the Services will not exceed the amount paid by you, if any, for accessing the Services.
12. Indemnification You agree to indemnify and hold harmless Freeroam.AI, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys’ fees, arising out of or related to your use of the Services, violation of these Terms, or violation of any rights of a third party.
13. Governing Law These Terms are governed by and construed in accordance with the laws of the State of South Dakota, without regard to its conflict of law principles. Any disputes arising out of or related to these Terms or the Services will be resolved exclusively in the courts of the State of South Dakota.
14. Modifications to Services Freeroam.AI reserves the right to modify or discontinue any aspect of the Services at any time, with or without notice. We are not liable for any modification, suspension, or discontinuation of the Services.
15. Entire Agreement These Terms, along with our Privacy Policy and any other agreements or policies incorporated by reference, constitute the entire agreement between you and Freeroam.AI regarding your use of the Services. If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
